Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PsTally’s website, dashboard, staff console, monitoring software and related services (the “Service”), provided by PsTally (“PsTally”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to do so.

The Service

PsTally is management software for gaming lounges and console centres. It lets you track gaming sessions, take and reconcile cash and mobile-money payments, manage staff shifts, monitor consoles over your network, record debts, expenses, cashouts and product sales, run tournaments, and receive shift reports. Features may be added, changed or removed as the Service evolves.

Accounts

You must provide accurate information and keep it up to date. You are responsible for all activity under your account, including your staff’s use, and for keeping your login credentials and staff PINs confidential. Notify us promptly of any unauthorised use. You must be at least 18 years old to hold an account.

Subscriptions, fees and billing

PsTally is offered on a subscription basis. The first month is free. After that, pricing is a monthly base fee plus a per-console charge, in the currency of your country, billed monthly (or annually where offered). Optional add-ons, such as the AI assistant, are charged separately where you choose them. We may change pricing on reasonable prior notice; changes take effect at your next billing cycle. Fees are exclusive of any taxes that may apply. Except where required by law, payments are non-refundable, including for partial periods.

Free trial

Your free trial gives you full access for the trial period at no charge and with no card required. If you continue after the trial, the applicable subscription fees begin. You may stop at any time during the trial without owing anything.

The PsTally Monitor

We grant you a limited, non-exclusive, non-transferable licence to install and use the PsTally Monitor application on a computer in your lounge, solely to operate your account. It detects consoles on your own network to flag unrecorded sessions. You may not copy, resell, reverse-engineer, or use it outside your own lounge. The licence ends when your account does.

Acceptable use

You agree to use the Service only for lawful gaming lounge management and in line with these Terms. You will not misuse the Service, attempt to access data that is not yours, disrupt or probe the system, resell or sublicense access, upload unlawful content, or use the Service to facilitate anything illegal. We may investigate and act on suspected violations.

Your data and content

The business records you create in the Service — sessions, payments, staff, customers, debts, sales and the rest — belong to you. You grant us the licence needed to host and process that data to provide the Service. You are responsible for the accuracy of what you enter, for the staff and customer information you record, and for obtaining any consents that information requires. You should keep your own copies of records important to your business; the Service is a tool, not your sole book of record. Our handling of personal data is described in our Privacy Policy.

Tournaments

Where you use the tournament feature, you are the organiser of your event and are responsible for it — including any entry fees, prizes, rules and conduct. If you choose to list a tournament publicly, you confirm you have the right to publish those details. PsTally provides the tools; we are not a party to your events and are not responsible for how they are run or resolved.

Third-party services

The Service works alongside third parties such as mobile-money providers (including M-Pesa) and WhatsApp. Your use of those services is governed by their own terms, and we are not responsible for them. We reconcile mobile-money payments; we do not process card payments ourselves.

Intellectual property

PsTally, its software, brand, and website are owned by us and protected by law. These Terms grant you the right to use the Service, not any ownership of it. You may not use our name or marks without permission.

Availability and “as is”

We work hard to keep the Service reliable, but it is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the Service will be uninterrupted, error-free, or that monitoring or figures will always be perfectly accurate.

Limitation of liability

To the maximum extent permitted by law, PsTally will not be liable for any indirect, incidental, special or consequential loss, or for lost profits, revenue, data or goodwill, arising from your use of or inability to use the Service — including losses from downtime, errors, or reliance on figures in the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the three months before the claim.

Indemnification

You agree to indemnify and hold PsTally harmless from claims and costs arising out of your use of the Service, your content or data, your events, or your breach of these Terms or of any law.

Suspension and termination

You may cancel your account at any time. We may suspend or terminate access for non-payment, breach of these Terms, or misuse. On termination, your right to use the Service ends; we will make your data available for export for a reasonable period, after which it may be deleted in line with our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. When we do, we will update the date above, and for material changes we will take reasonable steps to notify you. Continued use after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws of the Republic of Kenya, and any disputes will be subject to the jurisdiction of the Kenyan courts, without prejudice to any mandatory consumer rights you may have in your own country.
